BSB 2023: Chapter VII: Section 120

In a prosecution for rape under clause (a), clause (b), clause (c), clause (d), clause (e), clause (f), clause (g), clause (h), clause (i), clause (j), clause (k), clause (l), clause (m) or clause (n) of sub-section (2) of section 64 of the Bharatiya Nyaya Sanhita, 2023, where sexual intercourse by the accused is proved and the question is whether it was without the consent of the woman alleged to have been raped and such woman states in her evidence before the court that she did not consent, the court shall presume that she did not consent.
Explanation.—In this section, "sexual intercourse" shall mean any of the acts mentioned in clauses (a) to (d) of section 63 of the Bharatiya Nagarik Suraksha Sanhita, 2023.

खंड (ए), खंड (बी), खंड (सी), खंड (डी), खंड (ई), खंड (एफ), खंड (जी), खंड (एच), के तहत बलात्कार के लिए अभियोजन में। भारतीय न्याय संहिता, 2023 की धारा 64 की उपधारा (2) के खंड (i), खंड (j), खंड (k), खंड (l), खंड (m) या खंड (n), जहां संभोग आरोपी द्वारा यह साबित कर दिया गया है और सवाल यह है कि क्या यह उस महिला की सहमति के बिना था जिसके साथ कथित तौर पर बलात्कार किया गया था और ऐसी महिला अदालत के समक्ष अपने साक्ष्य में कहती है कि उसने सहमति नहीं दी थी, अदालत यह मान लेगी कि उसने सहमति नहीं दी थी।
स्पष्टीकरण.—इस खंड में, "यौन संभोग" का अर्थ भारतीय नागरिक सुरक्षा संहिता, 2023 की धारा 63 के खंड (ए) से (डी) में उल्लिखित कोई भी कार्य होगा।< /पी>
